Florida Charity Registration Process Explained

As per the Florida Solicitation of Contributions Act, registration is mandatory for charitable organizations, sponsors, professional solicitors, and fundraising consultants.
Before beginning the registration process, your organization must have federal tax-exempt status approved by the IRS and at least three board members. If your organization receives at least $500,000 or more than $1 million in annual contributions, you must have your financial statements reviewed or audited by an independent certified public accountant (CPA).
For initial registration, you’ll need the following documents:
- A completed registration application signed by an officer of the organization (e.g., chairman, president, or executive director)
- A copy of the IRS Determination Letter
- Proof of DBA/fictitious business name filing in domicile state (if applicable)
- Signed Form 990 and all schedules, Form 990-ex and Schedule O, budget (newly formed organizations only), or FDAC-10122 solicitation of contributions annual financial reporting form
- An audit report (required only if your organization receives more than $1 million in contributions)
- A CPA review (required only if your organization receives more than $500,000 in contributions)
- A list of current board members
- A list of any professional fundraisers or fundraising consultants involved, along with copies of their contracts (if they are active in Florida)
- A list of Florida co-ventures, along with related contracts (if applicable)
Registration Process
Once you’ve gathered all the required documents and completed the prerequisites for applying, proceed with the registration using the following steps:
- Access the registration form for charitable organizations.
- Input details about your organization, including the legal name, fictitious or alternate names, and contact details (address, phone number, website, email).
- Specify whether the organization is an LLC, Corporation, Partnership, or Sole Proprietorship.
- Provide a clear description of the organization’s mission and the purpose for which the funds will be used.
- Indicate the month and day your fiscal year ends and provide details about your revenue and expenses.
- Confirm that you’ve attached the CPA audit (if applicable to you).
- Answer questions regarding any convictions, violations, or regulatory actions taken against the organization or its officers, directors, or trustees.
- Make a check or money order payable to FDACS for the calculated registration fee.
Florida Charitable Registration Renewal
All charitable organizations are required to renew their registrations with the FDACS annually. To do this, organizations must submit their updated financial information, including any changes from the previous year.
The easiest way to renew your registration is by completing the process online through an FDACS account. Note that the financial information you provide must reflect the organization’s actual contributions and expenses from the previous year. Additionally, you must submit an IRS Form 8868 with the renewal if the organization is requesting an extension. FDACS will grant an extension that matches the date allowed by the IRS.
However, if you fail to complete the renewal by the due date and do not request an extension, a late filing fee of $25 will be charged for each month (or part of a month) the renewal is delayed.
Organizations Exempt From Florida Charitable Solicitation Registration
Certain organizations are exempt from the registration requirements under the Florida Solicitation of Contributions Act, including:
- Bona fide religious or educational institutions
- Federal, state, or local government agencies
- Political organizations and groups involved in political advocacy
However, these organizations must still send an email to the state to receive the exemption, though no registration or form/fee is required.
Additionally, if you run a small organization that raised less than $50,000 in contributions in the preceding fiscal year and is entirely operated by unpaid personnel (volunteers, members, or officers), you can follow a simplified application process instead of the full registration process. You must fill out the Small Charitable Organizations/Sponsors Application and complete the Solicitation of Contributions Annual Financial Reporting Form. You’re also not required to pay any registration fee in this case.
However, if you’ve filed as a small charity/sponsor and have exceeded $50,000 in total contributions at any point during the fiscal year, you must register with FDACS within 30 days of reaching that amount.

A late filing fee of $25 will be charged for each month, or part of a month, in which the annual renewal statement and financial report are not filed by the due date.
Even if you don’t receive any money, you still need to renew your registration. The information reported to the IRS should also be included in your renewal and available to the public through Check-A-Charity.

Reinstatement
Not required
Formal reinstatement is not required. Charities that do not submit their financial statement (FDACS-10122 Solicitation of Contributions Annual Financial Reporting form) by the due date or granted extension date will have their registration placed in a suspended status. The registration will remain in a suspended status until the delinquent financial statement is received. A renewal application does NOT have to be submitted with the financial statement unless the organization is due for a renewal.
If a license is expired then it will stay in an expired status until the organization submits its delinquent renewal with all applicable fees (renewal + late fees).

Commercial Co-venturer licensure is not required on the State level in Florida.
Florida does not currently have a traditional registration requirement for commercial co-venturers, but they may need to follow other regulations before and after fundraising events.
