Companies that provide insurance producer services in New York must apply for a license prior to doing
business. Depending on the lines of authority offered by the entity and the types of services offered, multiple
firm licenses may be required.
Before applying, firms should ensure that the licensed individual to be appointed agent in charge has the
necessary licenses. Firms should also gather proof of incorporation, or foreign qualification for out-of-state
firms, in anticipation of application requirements.
New York Excess Lines License - Non-Resident (Agency)

Any DRLP supplied on the application must be listed as an officer, owner, director, partner, member, or manager. Employees should not be listed.
Qualifying Individual Requirements:
DRLP must be actively licensed in New York (resident or non-resident) for the same license class and must cumulatively cover the line(s) of authority being applied for by the business entity.
Each DRLP supplied on the application must also be listed on the owner, partner, officer, or director (OPOD) section of the application.
Any DRLP supplied on the application must be listed as an officer, owner, director, partner, member, or manager. Employees should not be listed.
Qualifying Individual Requirements:
DRLP must be actively licensed in New York (resident or non-resident) for the same license class and must cumulatively cover the line(s) of authority being applied for by the business entity.

The names of all corporations, partnerships, limited liability companies and trade names must receive prior approval from the Department of Financial Services for use in New York. Name changes for entities must also receive prior approval. The name must first be submitted to the Department for consideration, and either approval or disapproval will be forwarded in writing, along with the appropriate application and instructions

For Workers' Compensation policies, use Certificate of NYS Workers' Compensation Insurance Coverage (Form C-105.2).
For Disability Benefits policies, use Certificate of Insurance Coverage under the NYS Disability and Paid Family Leave Benefits Law (Form DB-120.1).
For Exemption, use Certificate of Attestation of Exemption (Form CE-200).
Corporate entities must designate an officer of the corporation as the person responsible for ensuring that the corporate entity complies with all the laws, regulations, policies, procedures, and directives relating to the administration of workers' compensation claims in New York State.

Set of UR policies and procedures, including UR plan, demonstrating Agent’s ability to carry out the relevant requirements of Insurance Law
Certificate of Incorporation in New York State or other documentation that the Agent has been approved by the Secretary of State to do business in New York State

An individual can also be licensed as a personal lines agent who is authorized to sell, solicit or negotiate non-commercial insurance to individuals and families, rather than businesses and organizations.
A property casualty agent or personal lines agent represents New York authorized companies for which he/she has been appointed. A company appointment is not required to obtain an agent license. However, a notice of appointment must be electronically submitted to the Department within fifteen (15) days from the date the agency contract is executed, or the first insurance application is submitted.
A property casualty broker represents the insured and can place business with any New York authorized company that will accept it. Some companies will only accept business from appointed age

Exceptions from the prelicensing requirements:
A candidate for the either the agent or broker license who holds the Chartered Property Casualty Underwriter designation may waive the education requirement and may take the Property Casualty Laws and Regulations exam.
A candidate for the broker license may wave the education requirement if he/she were regularly employed by an insurance company, broker or agent for a period of not less than one year during the last three years in responsible insurance duties relating to the underwriting or adjusting of losses in any one or more of the following branches of insurance: fire, marine, liability and workers' compensation, fidelity and surety, property and casualty. A person serving with the Armed Forces may also qualify on the basis of such experience if the one-year period of employment was during the three years next preceding his/her entry into the Armed Forces, and he/she applies within one year after discharge. The candidate must submit a signed and completed Statement of Employer with the license application.
