New Mexico Engineer of Record Affidavit

Business Corporations:

  • Officers and directors need not be licensed, but the corporation must appoint a New Mexico licensed individual to be responsible for all professional activities undertaken by the firm in New Mexico.

Professional Corporations:

  • All shareholders and incorporators must be individuals licensed in a professional service provided by the firm or entities that are similarly qualified.

Limited Liability Companies:

  • Members and managers need not be licensed, but the LLC must appoint a New Mexico licensed individual to be responsible for all professional activities undertaken by the firm in New Mexico.

Partnerships:

  • At least one of the partners must be a New Mexico licensed engineer.

Domestic Applicants:

  • Identify a New Mexico licensed engineer to act as the individual in responsible charge of the firm's engineering activities in New Mexico.

 

Foreign Applicants:

  • Ensure that your New Mexico entity meets ownership requirements.
  • Identify a New Mexico licensed engineer to act as the individual in responsible charge of the firm's engineering activities in New Mexico.
  • If foreign qualifying, obtain a certificate of good standing from your business entity's home state (to be filed during the foreign qualification process). The certificate cannot be more than 30 days old when filing foreign qualification documents.
How to Apply:

Domestic Applicants:

  1. File entity formation documents with the New Mexico Secretary of State - Corporations Bureau.
  2. Submit a completed engineer of record affidavit to the New Mexico Board of Licensure for Professional Engineers and Professional Surveyors.

Foreign Applicants:

  1. Determine whether or not your entity will need to foreign qualify in New Mexico. If not required, skip to number 3.
  2. File foreign qualification documents with the New Mexico Secretary of State - Corporations Bureau.
  3. Submit a completed engineer of record affidavit to the New Mexico Board of Licensure for Professional Engineers and Professional Surveyors.

An electronic signature, as an option to a permanently legible signature, is acceptable for professional documents. The licensee shall provide adequate security regarding the use of the seal and signature.

A. Each licensed professional engineer shall obtain a seal/stamp, which shall appear on all final engineering design drawings, the certification page of all specifications and engineering reports prepared by the licensee in responsible charge. Adjacent to the seal/stamp shall appear the original signature of the licensee along with the date the signature was applied. Rubber stamps signatures are not acceptable. Electronic signatures as provided by law and board’s policy shall be acceptable.

B. The seal/stamp shall be the impression type seal, the rubber type, or a computer-generated facsimile. Computer generated seals shall be bona fide copies of the actual seal/stamp specific to the work being presented.

  • Five references, three must be from licensed professional engineers. All references must be included on the supplied Reference Form, which can be opened and filled out with Adobe Reader (to obtain the latest version, please visit https://get.adobe.com/reader/ for a free download). Completed forms must be received in the Board office directly from the references. 
  • Official transcript(s) (posting the degree(s) earned and received by the board directly from the school) 
  • Verification of having successfully completed the Fundamentals of Engineering (FE) examination if completed in another state. All information must be on the supplied Verification Form, or through the NCEES verification portal. Form(s) must be received by the board directly from the state board office.

Design Firm - Engineering firm registration is sometimes grouped with architecture and land surveying on a single “design firm” application form.

EI (Engineering Intern) - A term also used to describe an Engineer in Training.

EIT (Engineer in Training) - A professional designation granted upon having completed at least 3 years of school at an ABET-accredited university and having passed the FE exam.

FE (Fundamentals of Engineering) - An exam testing on basic engineering principles that is required to become an engineer in training.

PE (Professional Engineer or 'Principles and Practice in Engineering') - Means either Professional Engineer or refers to the Principles and Practice in Engineering exam that is a prerequisite for an engineering license.

Reciprocity - When a licensed engineer in one state can provide documentation (often an NCEES Record) to more easily apply for a license in another jurisdiction.

Accrediting board that sets standards for university programs in a variety of applied science disciplines.

American Council of Engineering Companies (ACEC)
Engineering, architecture, and land surveying advocacy group.

American Society of Civil Engineers (ASCE)
Organization that provides continuing education, professional conferences, and advocacy efforts to the civil engineering community.

American Society of Mechanical Engineers (ASME)
Mechanical engineering organization that focuses on education and professional development.

Engineering Accreditation Commission (EAC)
Reviews accreditation requirements and makes final decisions regarding the accreditation process.

National Council of Examiners for Engineering & Surveying (NCEES)
Develops, administers, and scores the exams used for engineering licenses.

National Society of Professional Engineers (NSPE)
NSPE is an advocacy group for professional engineers.
