Missouri Real Estate Company License

Ownership Requirements:
  • If doing business under any name other than the exact name registered with the Missouri Secretary of State, the fictitious name must be filed with the Missouri Secretary of State and a copy of the approved registration must be included with the application. 
  • If filing a fictitious name, complete the registration form showing the firm as the owner; individuals can not be listed as owners. 
  • Limited Liability Companies:
    • Resident limited liability companies must attach a copy of the Certificate of Organization from the Missouri Secretary of State 
    • Foreign limited liability companies must attach a copy of the Certificate of Organization filed in the resident state and attach a copy of the Certificate of Registration of Foreign Limited Liability Company received from the Missouri Secretary of State's office. 
  • Corporations:
    • Resident corporations must attach a copy of the Certificate of Incorporation from the Missouri Secretary of State's Office 
    • Nonresident corporations must attach a copy of the Certificate of Foreign Authority received from the Missouri Secretary of State's Office 
  • General Partnerships:
    • Must attach a copy of the approved fictitious name registration received from the Missouri Secretary of State's Office 
    • If forming a Limited Liability Partnerships, attach a copy of the certificate of registration from the Missouri Secretary of State's Office and a copy of the approved fictitious name registration if using a name other than the name of the certificate of registration. 
Financial Requirements:

A copy of a completed Consent to Examine and Audit Escrow or Trust Account form must be attached.

Each broker-officer, broker-associate, or broker-partner licensed in Missouri must retain a comparable position/title within the firm. 

Initial Registration

Form:

Application for a Real Estate Corporation, Partnership, or LLC License or Professional Corporation Application.

Instructions:
  • Before a broker license will be issued to a partnership, association, or corporation, each partner in a partnership or each associate in an association or each officer of a corporation, who actively participates in the supervision of the real estate brokerage business of the firm shall hold the appropriate broker license and each broker-salesperson or salesperson associated with the firm who engages in activities defined in the license law shall hold the appropriate license.
  • In addition, each broker partner, broker-associate, or broker-officer shall retain a comparable position/title within the firm. An individual that maintains a salesperson license may also hold an officer title within a corporation.
