New Mexico Contractor License

Notes:

Corporations, Limited Liability Companies, Limited Partnerships, Limited Liability Partnerships:

  • Corporations, LLCs, LPs, and LLPs must be licensed even though one or more stockholders, members, or partners have a license or qualifying party certificate
  • Corporations, LLCs, LPs, and LLPs must be legally authorized to do business in New Mexico to be eligible to apply for, renew, or retain a license
  • Any license issued to a corporation, LLC, LP or LLP shall automatically cancel when the entity ceases to exist under New Mexico law

Joint Ventures:

  • No two or more persons shall submit a joint bid or jointly engage in contracting unless operating as a validly licensed joint venture
  • To be eligible to apply for, renew, or retain a license, each entity comprising the joint venture must hold a valid New Mexico contractor license and be legally authorized to do business in New Mexico
  • Any license issued to a joint venture entity shall automatically cancel when the entity ceases to exist under New Mexico law

Partnerships:

  • A partnership must be legally authorized to do business in New Mexico to be eligible to apply for, renew, or retain a license
  • Any license issued to a partnership shall automatically cancel when the partnership ceases to exist under New Mexico law

Sole Proprietorships:

  • A sole proprietorship must be legally authorized to do business in New Mexico to be eligible to apply for, renew, or retain a license
  • On the death of a sole proprietor, the license shall automatically cancel

How to Apply:

Domestic Applicants: 

  1. File entity formation documents with the New Mexico Secretary of State to form your business entity.
  2. Appoint a qualifying party for each classification of work covered by the license. 
  3. Check with PSI to make sure that the name you intend to use on license is available
  4. Complete a Qualifying Party Certificate  or a copy of the exam report showing passing scores on exams. 

Foreign Applicants: 

  1. File  a foreign qualification application with the New Mexico Secretary of State.
  2. Appoint a qualifying party for each classification of work covered by the license. 
  3. Check with PSI to make sure that the name you intend to use on license is available
  4. Complete a Qualifying Party Certificate or a copy of the exam report showing passing scores on exams. 
     
Required Attachments:
  • Copy of valid qualifying party certificate, or copy of exam score report showing passing scores on exam(s) for applicable classification(s). May submit official transcript showing passing grade on business and law course administered by a CID approved school in lieu of passing score on business and law exam. If a Qualifying Party intends to qualify two or more licenses at the same time, you
    MUST submit proof of at least thirty people (30%) common ownership between all of the licensed entities. Please list all company license names and numbers, and all ownership information for each license.
  • Proof of Financial Responsibility: Bond - must be issued in the exact name shown on the application.
  • Proof of current (within the last year) New Mexico Tax ID number application with an official stamp or registration certificate. Must be issued in the exact name shown on the application.
  • If a Corporation, Limited Partnership, Limited Liability Partnership, or Limited Liability Company, provide proof of registration with the New Mexico Secretary of State (505)827-3600. Must be issued in the exact name shown on the application.
  • Self-addressed envelope large enough and with sufficient postage to return your application materials if your application is rejected. If your application is accepted, this envelope will be used to send your new license once it has been issued.

  • In the event a licensee loses its qualifying party, through termination of employment or otherwise, both the licensee and the qualifying party must notify CID or its designee in writing of the separation within 30 days thereof.

Notes:

Once a license has been obtained, each manufacturing plant is required to submit a written report to the division of all new homes shipped into or within New Mexico. The report must be filed by the 15th day of the month following the shipment month and should contain the following information:

  • New Mexico license number and name
  • Serial number and H.U.D. label number assigned to the home
  • Name of the retailer to whom the homes are delivered

Penalties:

Licenses not renewed within 30 days of expiration will incur a penalty in the amount of $1/day for the first 30 days and thereafter a fee equal to twice the amount of the license fee. Renewal applications submitted more than 1 calendar year past the expiration of the license will be treated as new applications.

All QP certificates are valid indefinitely as long as they are attached to an active license. Once detached from a license, a QP Certificate will automatically cancel if not reattached to a license within two consecutive years and will have to reapply and retest.
