Ownership Requirements:
  • If the firm is a corporation, this application must be signed by the President and Secretary of the corporation and the responsible broker.
  • If the firm is a partnership, association, or limited liability company, this application must be signed by all members and acknowledged by the responsible broker. 
Insurance Requirements:

Errors and omission insurance is required for all active brokers, broker associates, property managers, real estate auctioneers, residential rental agents, and salespeople. A group policy for errors and omissions insurance is offered by the South Dakota Real Estate Commission (SDREC) through Rice Insurances Services Company, LLC (RISC).

Notes:

Persons moving to South Dakota who presently hold a real estate license in their resident jurisdiction: If you presently hold a real estate license in your state of residence and are moving to South Dakota, or if you have already moved to South Dakota and still hold a license in your previous state of residence, you may acquire the equivalent license in South Dakota by submitting a certificate of licensure showing good standing along with the application.

Qualifying Individual Requirements:
  • There must be an individual designated as the responsible broker, auctioneer or property manager who will represent the firm. 
  • Educational requirements:
    • 116-hour prelicensing course
    • 15-hour responsible broker course 
  • Experience of at least 2 years of active status
  • An Exam score of 75% Approval of Application

Instructions:
  • Nonresidents of South Dakota seeking to obtain the equivalent South Dakota license must successfully complete the below requirements.
    • Request DCI fingerprint cards from the Real Estate Commission. Comeplte this form and send via email to dlr.realestate@state.sd.us
    • Register and pass the State Exam at goamp.com
    • Mail packet to the Real Estate Commission containing:
      • Completed application with the appropriate fee
      • Original score report for the state portion of licensing examination
      • Certificate of license history from the real estate regulatory agency from each state/jurisdiction in which you currently hold or have ever held a license (must be dated within the last 30 days)
      • Proof of errors and omissions insurance 
      • Completed fingerprint cards and check for $43.25 made payable to "DCI"
    • You will need to contact the South Dakota Department of REvenue for business tax infromation

Penalties:

Any licensee who does not submit the renewal application by January 1 will be placed on a non-renewal status and will have until June 30 to complete the renewal application. As of July 1 if a licensee has not completed the renewal application, the license will become invalid and will no longer be eligible for renewal. Renewal applications received from December 1 through June 30 will be subject to late fees.
