Sole-proprietorships, partnerships, and other associations that do not want to include their surnames in the company name may be required to file a registration for a fictitious name. Legally incorporated companies and certain joint stock associations are not required to file a registration.

County Level Filing:

Fictitious names are filed at the county level in Delaware.

Does registration prevent others from using the name I choose?:

Trade name registration does not offer name protection.

  • Fictitious names are registered in the county prothonotary's office.
  • There is no DBA filing at the state level.
  • Publication of registration is not required in Delaware.
