{"id":5806,"date":"2022-06-23T14:26:32","date_gmt":"2022-06-23T18:26:32","guid":{"rendered":"https:\/\/www.harborcompliance.com\/blog\/?p=5806"},"modified":"2022-06-23T15:00:59","modified_gmt":"2022-06-23T19:00:59","slug":"when-should-i-register-a-trademark","status":"publish","type":"post","link":"https:\/\/www.harborcompliance.com\/blog\/when-should-i-register-a-trademark\/","title":{"rendered":"When Should I Register a Trademark?"},"content":{"rendered":"\n<figure class=\"wp-block-image size-full\"><a href=\"https:\/\/www.harborcompliance.com\/blog\/wp-content\/uploads\/2022\/06\/blog-when-should-i-register-a-trademark.jpg\"><img loading=\"lazy\" decoding=\"async\" width=\"800\" height=\"420\" src=\"https:\/\/www.harborcompliance.com\/blog\/wp-content\/uploads\/2022\/06\/blog-when-should-i-register-a-trademark.jpg\" alt=\"\" class=\"wp-image-5837\" srcset=\"https:\/\/www.harborcompliance.com\/blog\/wp-content\/uploads\/2022\/06\/blog-when-should-i-register-a-trademark.jpg 800w, https:\/\/www.harborcompliance.com\/blog\/wp-content\/uploads\/2022\/06\/blog-when-should-i-register-a-trademark-300x158.jpg 300w, https:\/\/www.harborcompliance.com\/blog\/wp-content\/uploads\/2022\/06\/blog-when-should-i-register-a-trademark-768x403.jpg 768w, https:\/\/www.harborcompliance.com\/blog\/wp-content\/uploads\/2022\/06\/blog-when-should-i-register-a-trademark-480x252.jpg 480w\" sizes=\"auto, (max-width: 800px) 100vw, 800px\" \/><\/a><\/figure>\n\n\n\n<p>A common question for entrepreneurs and small businesses is, &#8220;When should I register a trademark?&#8221;<\/p>\n\n\n\n<p>Let\u2019s look at 5 key points to consider.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">1. <strong>First, you should register for a federal trademark when you want to protect the GOOD WILL of your brand.&nbsp;<\/strong><\/h2>\n\n\n\n<p>Small business owners spend hard-earned money building a brand.&nbsp;&nbsp;<\/p>\n\n\n\n<p>By registering your trademark with the United States Patent and Trademark Office, you can protect your company\u2019s goodwill from potential infringers.&nbsp; Specifically, you can bring a lawsuit for trademark infringement into federal court.&nbsp; Or, you can send a cease and desist letter, indicating that you have the federal rights to your trademark.&nbsp;<\/p>\n\n\n\n<p>By not protecting themselves with a federal trademark, you risk OTHER companies using a trademark that is identical or highly similar to yours.&nbsp; In certain instances, other companies may argue that you are infringing on their trademark rights, especially if they file for a federal trademark before you do.&nbsp;<\/p>\n\n\n\n<p>Federal trademark registration allows broad protection for your trademark <strong>across the entire United States.<\/strong><\/p>\n\n\n\n<p>So, you should first consider whether there is a trademark \u2013 whether it be a company\u2019s name, an expression, or even a logo \u2013 that you believe promotes &#8212; or will one day establish &#8212;&nbsp; brand value.&nbsp;&nbsp;<\/p>\n\n\n\n<p>If you believe that a word or a logo does or will be important for brand value, <strong>you should strongly consider federal trademark protection.&nbsp;&nbsp;<\/strong><\/p>\n\n\n\n<div>\n<script src=\"https:\/\/fast.wistia.com\/embed\/medias\/855wz70zgx.jsonp\" async=\"\"><\/script><script src=\"https:\/\/fast.wistia.com\/assets\/external\/E-v1.js\" async=\"\"><\/script><div class=\"wistia_responsive_padding\" style=\"padding:56.25% 0 0 0;position:relative;\"><div class=\"wistia_responsive_wrapper\" style=\"height:100%;left:0;position:absolute;top:0;width:100%;\"><div class=\"wistia_embed wistia_async_855wz70zgx seo=false videoFoam=true\" style=\"height:100%;position:relative;width:100%\"><div class=\"wistia_swatch\" style=\"height:100%;left:0;opacity:0;overflow:hidden;position:absolute;top:0;transition:opacity 200ms;width:100%;\"><img decoding=\"async\" src=\"https:\/\/fast.wistia.com\/embed\/medias\/855wz70zgx\/swatch\" style=\"filter:blur(5px);height:100%;object-fit:contain;width:100%;\" alt=\"\" aria-hidden=\"true\" onload=\"this.parentNode.style.opacity=1;\"><\/div><\/div><\/div><\/div>\n<\/div>\n\n\n\n<p><\/p>\n\n\n\n<p>This brings us to the second consideration&#8230;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>2. Once you decide that you want a trademark,<\/strong> <strong><em>when <\/em>should you register?<\/strong><\/h2>\n\n\n\n<p><strong>Well, there are two ways to register your trademark:&nbsp;<\/strong><\/p>\n\n\n\n<p>When you <strong>already <\/strong><em>are<\/em> selling products or providing services with the trademark <strong>OR<\/strong> When you <strong>intend<\/strong><em> <\/em>to sell products or provide services with the trademark.<\/p>\n\n\n\n<p>The first option means you\u2019ve already begun using the trademark with your products or services.&nbsp; For example, you may have already sold t-shirts or provided bakery services with that trademark.<\/p>\n\n\n\n<p>The second option means you have a <strong>bona fide intent<\/strong> to sell a product or provide services with a trademark.&nbsp; This means you are making a sworn statement that you have a true intent to use this trademark to sell products or provide services with a trademark.&nbsp;&nbsp;<\/p>\n\n\n\n<p><strong>The Third Key Point?&nbsp;<\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>3. You\u2019ll want to file as soon as possible, even if you are not already using the trademark!<\/strong><\/h2>\n\n\n\n<p>Let\u2019s say you are planning to use a trademark, but are not yet selling or providing the products or services.&nbsp; If you apply for a federal trademark under a 1(b) basis, you can get the <strong>priority date<\/strong> of the date you submitted your application!&nbsp; This priority date is important because it is <strong>nationwide in effect,<\/strong> <strong>and provides notice to others about the rights to your trademark.<\/strong><\/p>\n\n\n\n<p>So, let\u2019s say you filed a 1(b) trademark application on January 1<sup>st<\/sup>.&nbsp; You\u2019ll eventually provide evidence to the USPTO that you are using your trademark in business, but you won\u2019t have to provide that evidence in your initial application.&nbsp; Then, let\u2019s say you start using your trademark in business on June 1, and submit proof to the USPTO on June 1<sup>st<\/sup>.&nbsp; Then, your trademark is registered on the Principal Register on August 1.<sup>st<\/sup>.<strong>&nbsp; <\/strong>When your trademark registers, legally your trademark will be treated <strong><em>as if<\/em><\/strong> you had used your trademark <strong>in business<\/strong> on January 1<sup>st<\/sup>!&nbsp;&nbsp;<\/p>\n\n\n\n<p>Let\u2019s also use an example of how this date establishes your priority to the legal rights to your trademark.<\/p>\n\n\n\n<p>Suppose on January 1<sup>st<\/sup> you filed the trademark MOONSTRUCKY for balloons as a 1(b) application.&nbsp; If another company, on January 2, starts using that same trademark with similar goods, you will have priority to the rights of that trademark when it registers on the Principal Register with that January 1<sup>st<\/sup> priority date. &nbsp; So, even though you weren\u2019t actually selling your balloons with your trademark on January 1<sup>st<\/sup>, the law will still treat it as if you were for priority purposes!<\/p>\n\n\n\n<p><strong>The Fourth Key Point?&nbsp;<\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>4. You should file for a trademark after conducting your due diligence<\/strong>.<\/h2>\n\n\n\n<p>You want to conduct due diligence before spending money on a federal registration.&nbsp; For instance, the USPTO has a database that lets you search for similar pending or registered trademarks.&nbsp; We also have a video on how to search for direct hits.&nbsp; While a direct hit search isn\u2019t exhaustive, it will provide you with any clear examples of similar trademarks.&nbsp;<\/p>\n\n\n\n<p>Video 5 teaches you how to do a direct hit search on the USPTO database.&nbsp;<\/p>\n\n\n\n<p>By conducting due diligence, you develop a better understanding of whether your mark will be registered by the USPTO.&nbsp;&nbsp;<\/p>\n\n\n\n<p><strong>The Fifth Key Point?&nbsp;<\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">5. <strong>File after making a business (and personal) decision<\/strong>.<\/h2>\n\n\n\n<p>Filing for a trademark is a business, legal, and <strong>personal<\/strong><em> <\/em>decision.&nbsp; It involves weighing the potential legal and business risks of <strong>not<\/strong><em> <\/em>filing for a trademark and the impact of not doing so on your brand value.&nbsp;&nbsp;<\/p>\n\n\n\n<p>Ultimately, you want to think a great deal about the brand of your business, and spend considerable thought on what names, logos, or designs, you want associated with that brand.&nbsp;&nbsp;<\/p>\n\n\n\n<p>Maybe you hire an artist to help you with a certain logo, or workshop names for a company with friends, family, and even focus groups.&nbsp;&nbsp;<\/p>\n\n\n\n<p>Remember that this trademark is a long-term decision.&nbsp; You want to make sure you love this name or logo!<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p><em>Jimmy McNamara is an attorney and founder of TrademarkEd, LLC, an educational platform for all stages of the federal trademark application process.
